What If She-Hulk Defends Scarlet Witch In Court?

She-Hulk has been representing quite a few super-powered individuals including Wong and Abomination. However, the cases have definitely been more lighthearted with many comical elements. But what if She-Hulk was to defend Scarlet Witch? This would give Jen the opportunity to explore a more serious case. The case would also be extremely difficult to defend. After all, Wanda caused unimaginable damage during Multiverse of Madness. However, it would give She-Hulk a challenge to take on and help a fellow female superhero. This would also be a great chance for MCU to explore Wanda’s side and the emotions she must have felt during the entire events of Doctor Strange 2.

What are the charges on Wanda?

There’s obviously murder because she killed a lot of sorcerers during her attack on Kamar-Taj. There’s also the destruction of property and large-scale destruction in the multiverse. She also attempted to murder America Chavez and chased her throughout the multiverse. This would be an exceptionally tough case for She-Hulk to defend. However, for those wondering how she could possibly pull off this miracle, there is a defense available. During the entirety of Doctor Strange in the Multiverse of Madness, Wanda was using the Darkhold and had been doing so for quite some time then. So as she used the Darkhold and learned about the multiverse and the various spells, it corrupted her mind and negatively influenced her.

Doctor Strange himself says, “Wanda’s gone. She’s got the Darkhold and the Darkhold has her.” This would allow She-Hulk to use the insanity plea by which she would argue that Wanda was not in the proper state of mind when committing those crimes. In fact, Wong or Doctor Strange who are very well versed in matters of the mystic arts could act as expert witnesses, They could testify regarding the Book of the Damned and how it corrupts everything it touches. Moreover, she was also extremely grief stricken which also contributes towards mental instability. After all, she has had an extremely tough life. She has lost almost everyone important to her including her parent, brother, Vision and even her imaginary kids. Granted this would result in Wanda being sent to a mental institution, I would argue that she definitely needs it

If this case was to happen then the MCU can clear up a lot of legal questions and ambiguity with regards to the multiverse. While talking about the charges on Wanda, we did not mention her crimes in other universes. This is a major question that needs to be answered. If Scarlet Witch was to stand trial, would her multiversal crimes also be taken into account? This would include the murder of the Illuminati. Technically the other universes do not fall under the jurisdiction of Earth-616. Moreover, the crimes committed on Earth-838 were carried out by the Wanda of that Earth with Scarlet Witch simply dreamwalking using the Darkhold. This means that the justice system of our Earth needs to become acquainted with such magical concepts.

MCU could also introduce a superhero division in the Justice system much like in GLK and H in She-Hulk. There would ideally be judges who are adept at such supernatural happenings. Another issue with the case would be that the Darkhold book has been destroyed and thus would not be entered into evidence. This would also be an interesting way of exploring the mental illnesses that plague Wanda especially PTSD after ripping off the Time Stone from the love of her life and then watching him die right in front of her once again. All of this would definitely give a more nuanced touch to She-Hulk. It would also show us some genuine legal consequences of the actions of superheroes instead of simply brushing it off.
